U.S. Senator Charles E. Schumer
313 Hart Senate Building
Washington, DC 20510

Dear Senator Schumer,

The Citizen Power Alliance takes issue with your remarks about the PSC review on the Iberdrola acquisition of Energy East as reported in the D&C Schumer rips PSC staff on Iberdrola and in the Times Union Senator slams PSC in deal.

The Citizen Power Alliance is a coalition of independent groups organized to promote sound energy and environmental policy. CPA holds public officials and regulators accountable, while seeking the protection of the public interest.

Eco preservation demands fiscal responsibility and viable technological solutions. Community power requires government transparency and effective industrial regulation. Commerce must balance development and profit with responsible civic stewardship.

Several of our member groups vigorous oppose the foreign take over of a crucial domestic electric energy infrastructure. When the electric industry was deregulated the Public Service Commission was told by the NYS Legislature that a total separation between electric generation and transmission distribution was the law. Your harmful interference into the review process has not gone unnoticed to the numerous residents and voters who will bear the costs of this dreadful sell out of national interests.

Iberdrola has been cited for Anti-trust violation by the EU. They seek to control most of the industrial wind projects in New York State. It is eminently clear from the PSC evidentiary hearing that Judge Epstein is acting properly in his duty. Please review our testimony at the Rochester PSC hearing 2/21/08 pages 98 – 103:

The Citizen Power Alliance urges you in the strongest terms to abandon your ill-conceived conclusions that favor the Energy East acquisition. If you would like to discuss the merits of effective alternative energy for New York State, our alliance would be pleased to meet with you and your staff.

Your prompt reply would be appreciated by all our member groups.

Cordially,

James Hall for CPA
